1. Acceptance of Terms

By creating an account, accessing, or using the Stocker platform (the "Service"), you agree to be bound by these Terms & Conditions ("Terms") and our Privacy Policy. If you do not agree to these Terms, you must not register, access, or use the Service.

These Terms constitute a legally binding agreement between you ("User", "you", or "your") and Stocker ("we", "us", or "our").

2. Description of Service

Stocker is a technology and data analytics platform that provides stock market analysis, trading signals, screening tools, and educational content for stocks listed on the Pakistan Stock Exchange (PSX). The Service includes:

• Daily BUY/SELL signal scores based on technical and fundamental analysis
• Machine learning model predictions and rankings
• Price charts, technical indicators, and fundamental data
• Watchlist tracking and portfolio monitoring tools
• Educational resources and market commentary

The Service is provided as a Software-as-a-Service (SaaS) application accessible via web browser.

3. Not Investment Advice

Stocker is an independent, privately owned software company. Stocker is not affiliated with, endorsed by, or connected to the Pakistan Stock Exchange (PSX), the Securities and Exchange Commission of Pakistan (SECP), the Central Depository Company of Pakistan (CDC), or the National Clearing Company of Pakistan Limited (NCCPL).

Stocker is not a SECP-licensed investment adviser, stockbroker, sub-broker, asset management company, or any other type of regulated financial institution. We do not execute trades, hold client funds, manage portfolios, or provide personalized investment advice.

All analysis, signals, screeners, scores, alerts, and recommendations generated by the Service are produced by automated software for informational and educational purposes only and do not constitute financial, investment, or trading advice, or a solicitation, recommendation, endorsement, or offer to buy or sell any security.

Nothing in the Service is a recommendation as to any investment strategy. All investment decisions are your sole responsibility. You should conduct your own research and consult a SECP-licensed financial advisor before making any investment decision.

Past performance does not guarantee future results. Investing in stocks involves substantial risk of loss, including the loss of your entire investment.

4. User Accounts & Responsibilities

To access the Service, you must create an account. You represent and warrant that:

• You are at least 18 years of age. By registering, you represent that you are 18 or older. Minors may not use this Service.
• You have provided accurate, current, and complete information during registration
• You will maintain the security and confidentiality of your account credentials
• You will notify us immediately of any unauthorized access to your account
• You are responsible for all activities that occur under your account

You are solely responsible for any investment decisions you make based on information from the Service, and for the consequences of those decisions.

5. Acceptable Use

You agree NOT to:

• Use the Service for any illegal purpose
• Attempt to gain unauthorized access to our systems, data, or other users' accounts
• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of our software, algorithms, or machine learning models
• Use automated tools, bots, scrapers, or spiders to collect data from the Service
• Resell, redistribute, or sublicense access to the Service without our written permission
• Interfere with or disrupt the proper functioning of the Service
• Use the Service to build a similar or competing product
• Impersonate another person or entity
• Transmit malware, viruses, or any malicious code

6. Intellectual Property

All content, features, and functionality of the Service — including but not limited to text, graphics, logos, software code, algorithms, machine learning models, user interface design, and data compilations — are owned by Stocker and protected by intellectual property laws.

You may not copy, modify, distribute, or create derivative works from any content without our express written permission. Stock names, stock data, and market information are the property of their respective owners (including PSX and data providers) and are used here for informational purposes only.

7. No Warranty & Data Accuracy

The Service and all content are provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory.

Stocker does not guarantee the accuracy, completeness, currentness, timeliness, merchantability, or fitness for purpose of any data, analysis, score, or recommendation on the Service. Stock prices, technical indicators, fundamental data, and machine learning output may contain errors, omissions, or delays.

We have made our best effort to ensure the correctness of the information presented, but always verify information independently from authoritative sources before making any trading decision. Data may be sourced from third-party providers who may themselves have errors or delays.

We do not warrant that the Service will be uninterrupted, error-free, secure, or that defects will be corrected.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, STOCKER AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, LOSS OF DATA, LOSS OF CAPITAL, OR TRADING LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, OR ANY DECISION MADE OR ACTION TAKEN IN RELIANCE ON THE CONTENT.

STOCKER'S TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) PKR 5,000. IF YOU ARE USING THE FREE TIER, YOUR TOTAL AGGREGATE CLAIM IS LIMITED TO PKR 5,000.

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under the laws of Pakistan.

9. Service Availability

While we strive for high availability, we do not guarantee uninterrupted access to the Service. The Service may be unavailable due to scheduled maintenance, technical difficulties, third-party outages, or force majeure events. We are not liable for any losses resulting from service interruptions.

10. Non-Affiliation

Stocker is an independent software company. It is not affiliated with, endorsed by, or in any way officially connected to:

• Pakistan Stock Exchange (PSX) or any of its subsidiaries
• Securities and Exchange Commission of Pakistan (SECP)
• Central Depository Company of Pakistan (CDC)
• National Clearing Company of Pakistan Limited (NCCPL)
• Any broker, bank, or financial institution
• Any government body or regulatory authority

The names and marks of these organizations are the property of their respective owners and are used here only for reference to the markets and instruments our Service covers.

11. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Pakistan, without regard to conflict-of-laws principles. The courts of Pakistan shall have exclusive jurisdiction over any dispute, subject to the arbitration provisions below.

Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall first be attempted to be resolved by good-faith negotiation between the parties for thirty (30) days. If the dispute remains unresolved, it shall be referred to arbitration in Pakistan under the Arbitration Act, 1940, by a single arbitrator appointed mutually by both parties, conducted in the English language. Notwithstanding the foregoing, Stocker may seek injunctive or equitable relief in any court of competent jurisdiction to protect its intellectual property or confidential information.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes are effective immediately upon posting the updated Terms on this page. Your continued use of the Service after any changes constitutes acceptance of the updated Terms. We will make reasonable efforts to notify users of significant changes.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. You may close your account at any time by contacting us. Upon termination, all provisions of these Terms which by their nature should survive termination shall survive — including but not limited to Sections 3, 7, 8, and 11.
